General conditions of sale

(pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

1. Introduction and effectiveness of the General Conditions of Sale

These General Conditions of Sale (hereinafter, the “ General Conditions ”) have as their object the regulation of the distance selling of products and services made available, via the internet, on the website www.squisitoo.it (hereinafter, the “ Site ”) and the related payment and delivery, in compliance with the Italian legislation set out in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the “ Consumer Code ”).

The seller of the products and owner of the Site is: Kuccagna srl ​​with registered office at Via Guglielmo Marconi 28/A PALAZZO PIGNANO (CR), CF/PI n. 01687570190, REA: CR-193686 - PEC address kuccagnamarket@pec.host.it (hereinafter “ Squisitoo ”).

The person accessing the Site to make purchases (hereinafter the " Customer ") is required, before sending the order, to carefully read these General Conditions - which constitute a binding agreement - made available to him on the Site and which will be available to the Customer at any time also through the link contained in the confirmation email of each order to allow him to reproduce and store them.

If the person making purchases on the Site requests an invoice and/or is not a "consumer or user" as defined in Article 3, paragraph 1, letter a), of the Consumer Code, the withdrawal provisions set forth in Articles 7 and 8 of these General Conditions will not apply, nor, more generally, the provisions that, pursuant to the Consumer Code, apply only to "consumers."

Contracts concluded with Squisitoo through the Site are governed by these General Conditions in compliance with Italian law.

The characteristics and price of the various products on sale on the Site (hereinafter “ Product ” or “ Products ”) are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and submit the order form electronically, following the instructions on the Site. The Customer must add the Product to the Cart and, after having read these General Conditions (including the Course Regulations) and the Privacy Policy and confirmed their acceptance, must enter the shipping and billing information, select the desired payment method and confirm the order.

2. Conclusion of the contract and acceptance of the Conditions

By submitting an order from the Site, which constitutes a contractual proposal, the Customer acknowledges and declares that he or she has read all the information provided during the purchase procedure and fully accepts these General Conditions and the payment terms as well as the Privacy Policy.

The contract between Squisitoo and the Customer is deemed to be concluded upon acceptance of the order by Squisitoo. This acceptance will be communicated to the Customer via an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing information, a list of the Products ordered with their essential characteristics, the total price (including shipping costs), and the payment method used. The Customer must check the confirmation email and, if they find any errors in the order (billing or shipping address, contact information, or similar), they will have a set time limit from receipt of the email to contact Customer Service directly from the Site using the contact form in the Customer Service area. This time limit will be 2 hours. Under no circumstances will it be possible to accept requests to modify the contents of the cart. After this time limit, the order will be processed for shipment and changes will no longer be accepted, without prejudice to the Customer's rights set forth in Article 7 below.

Upon receipt of the order, Squisitoo reserves the right to verify the actual availability of the ordered products; in the event that one or more Products are unavailable, Squisitoo will contact the Customer with a proposal for alternatives.

For purchases of products with variable weights (meat, fish, fruit and vegetables, bread, dairy products, etc.), the measurements and weights indicated on the Site are approximate. Squisitoo makes every effort to match the requested weight. However, slight variations may occur, both in excess and in deficit. For the actual payment method, please refer to section 5.2 of these General Conditions.

3. Product Information

Product information and specifications are available, along with the relevant Product codes, on the Website. It is understood that the information on delivered Products may differ from that shown on the Website for reasons beyond Squisitoo's control (e.g., changes made to the Product by the manufacturer). Therefore, it is always important to check the label and information on the delivered Product. Squisitoo assumes no responsibility for the information provided on the Products by individual suppliers.
The visual representation of the Products on the Site, where available, generally corresponds to the photographic image accompanying the product description. It is understood that the image of the Products themselves is intended solely for presentation purposes and may not be perfectly representative of their characteristics and quality, but may differ in graphics, color, and size. In the event of a discrepancy between the image and the written product description, the product description always prevails.
Product prices include all taxes and duties. All prices are expressed in euros.


4 Standard Delivery in Italy:

For all destinations in Italy, shipping is via Standard Delivery . Shipping costs are calculated in euros and include VAT. They are displayed during checkout before final order confirmation.

The conditions applied are as follows:

  • For orders up to €98.99: shipping fee of €9.90
  • For orders over €99.00: free shipping

Refrigerated shipments:
For products requiring cold chain maintenance, a dedicated refrigerated shipping system is implemented, active only on Mondays and Wednesdays.

If the destination postcode is served by a specialized refrigerated courier, the order will be entrusted to that courier, selected based on the geographic area. Alternatively, if the postcode is not covered by such a service, shipping will still be carried out safely using Easy2cool insulated packaging, designed to keep the product at the right temperature throughout the entire journey.

4.1 Delivery to the Islands:

For shipments to Sicily and Sardinia, the following specific conditions apply:

  • For orders under €49.99: shipping fee of €17.90
  • For orders up to €98.99: shipping fee of €14.90
  • For orders over €99.00: free shipping

Refrigerated shipments to the Islands:
For island destinations, refrigerated shipping is also available on Mondays and Wednesdays only. This service is only available where the postcode is covered by a refrigerated courier; otherwise, shipments using Easy2cool insulated packaging will be made, as indicated above.

5. Payment methods and invoicing

5.1. Payment methods
The Customer can pay the price of the Products and the related delivery costs by credit or debit card, PayPal, or Squisitoo voucher.
To ensure maximum transaction security, Squisitoo does not store the customer's payment details, and transactions are processed on integrated secure servers. The relevant credit institution uses SSL protocol to encrypt data transmitted between its server and the customer's browser.

The relevant credit institution uses SSL protocol to encrypt data transmitted between its server and the customer's browser. This data is never recorded by the Squisitoo website.

· PayPal
Once the order has been confirmed, the Customer will be redirected to the PayPal website where they can make the payment using their account, a card (including prepaid cards), or in any case using the methods accepted by PayPal and in compliance with the relevant conditions.

· Delicious Good
The Customer must enter the data relating to the Squisitoo Voucher (Code communicated by email) after choosing this payment method during the purchase procedure.

5.2. Payment Authorization and Capture
For all orders placed – in the case of payment by credit card, PayPal or Squisitoo voucher (gift card) – upon confirmation of the order by the Customer, a pre-authorization of the total amount will be made on the selected payment method.
The actual payment will be captured only when the order is processed, i.e. when the products are shipped.
The amount charged will only include the products actually shipped, plus any shipping costs and additional services requested by the Customer. If one or more products are unavailable when the order is prepared, the corresponding amount will not be charged or will be promptly reversed, according to the timeframes established by the payment method used or the Customer's bank.

5.3 Refunds
In the event of a refund, this will be made using the same payment method used by the Customer for the order, unless the Customer has expressly requested a different method. The refund will be processed within 10 business days of Squisitoo's acceptance of the refund.

5.4 Order invoicing
If desired, the customer can request an invoice by selecting the appropriate box during the order process and entering their billing information, including their tax code and/or VAT number, company name (if applicable), and SDI Recipient Code. In this case, the invoice will be automatically sent to the customer's tax account, in accordance with the law. The customer is responsible for entering their billing information correctly and is expressly informed that, if they did not request an invoice when ordering, they can request one within the same day using the contact form on the Contact page.

6. Transport and delivery

Products purchased on the Site are delivered to the address indicated by the Customer during the purchase procedure in the specific "Shipping Data" field.
Standard Delivery is available Monday through Friday; holidays and national holidays are always excluded. Squisitoo is not responsible for unforeseeable or unrelated delays, or for any damage, loss, cost, incorrect or failed delivery of Products due to force majeure or unforeseeable circumstances (e.g., natural disasters, adverse weather conditions, strikes, accidents, etc.).
Once the Products have been shipped, the Customer will receive a confirmation email containing the tracking link, thanks to which they can monitor all stages of delivery in real time.

6.1 Standard Delivery – Services active in Italy:
The service includes two delivery attempts to the address indicated at the time of ordering. A notification will be left after each attempt. If the second delivery attempt fails, the goods will be returned to the warehouse and the customer will be charged for the delivery costs. Under no circumstances will the price charged be refunded for products no longer resellable to third parties (e.g., fresh or perishable products such as meat, cheese, fishmonger products, cured meats, delicatessen products, etc., or customized products), nor will shipping costs be refunded.


7. Right of withdrawal

The Customer has the right to withdraw from the purchase contract for any reason, without explanation and without penalty, except for the cases of exclusion set forth in point IV below. To exercise this right, the Customer must send Squisitoo a communication within 14 days of receiving the Products. If the Customer intends to exercise the right of withdrawal before receiving the Products, the withdrawal notice may be sent at any time before their receipt.
This communication must be sent by registered letter with return receipt and/or certified email, addressed to:

Once the communication has been received, Squisitoo Customer Service will open a case to manage the return and will communicate to the Customer the instructions on how to return the Products, which will take place via a courier indicated by Squisitoo itself.
The right of withdrawal is governed by the following conditions:
I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the right of withdrawal on only part of the purchased Product.
II. If the right of withdrawal is exercised, Squisitoo will refund the customer the full amount of the returned goods, including shipping costs where applicable, within 14 days of receiving the notice of withdrawal. Squisitoo reserves the right to withhold reimbursement until the goods are actually received. The refund will be made according to the procedures described in section 5.3 of these General Conditions.
III. Also in order to guarantee free returns pursuant to the following article 8, the Products must be returned in the same box in which they were received.
IV. In addition to the cases indicated in the Introduction (non-consumer customer and/or customer requesting an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

  • order of Products packaged to measure or clearly personalized;
  • ordering Products that are liable to deteriorate or expire rapidly;
  • order of sealed Products that are not suitable for return for hygiene or health protection reasons or that have been opened after delivery.

With reference to the cases where withdrawal is excluded listed above, the Customer is specifically informed and accepts that these include all food products (including wines, spirits, and beverages), as the characteristics and qualities of these types of products are subject to alteration, including as a result of improper storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal applies only to products purchased on the Site that can be returned to Squisitoo and re-marketed without posing a risk to consumer health (such as gadgets, kitchen utensils, etc.).
In cases where the right of withdrawal is excluded, Squisitoo will return to the Customer the Products purchased and returned by the Customer, charging the Customer the return costs, or will dispose of them where necessary.


8. Free returns in case of exercising the right of withdrawal

As a more favorable condition for the Customer - in the event of exercising the right of withdrawal - Squisitoo will cover all shipping costs for returning the Products.
In order to benefit from this free shipping, the Customer who intends to exercise the right of withdrawal must follow the procedure indicated in the previous article 7 and wait to be contacted by Squisitoo to arrange the return of the Products to the courier.

9. Cancelling, postponing or changing the shipping address of the order

The Customer may cancel, postpone, or request a change of shipping address within a limited time frame from the order's completion; for Standard Delivery, this limit is 2 hours. After this time, the order will be processed and cancellation or shipping address changes will no longer be possible.
The Customer must contact Customer Service directly from the Site using the specific contact form accessible in the Customer Service area.
Squisitoo reserves the right to cancel the order in the event of unforeseeable difficulties, informing the Customer by email or telephone, or, by prior agreement with the Customer, changing the delivery date.

10. Bottles of wine with potential organoleptic alteration

If the Customer detects anomalies in the organoleptic profile of a bottle of wine purchased (for example, the presence of unpleasant odors attributable to the so-called "cork taint"), he or she may report it to Squisitoo by email to info@squisitoo.com, indicating the order number and precisely describing the perceived defect.
In order for the report to be taken into consideration, it is necessary that:

  • the bottle is equipped with a natural cork stopper (screw, synthetic or glass stoppers are not subject to the traditional cork defect);
  • at least 75% of the original contents, with the cap, must be preserved to allow for any checks;
  • the report must be accompanied by clear photographs of the bottle and the cork.

It's important to note that the assessment of any organoleptic alterations in wine is subject to subjective and variable factors (such as, for example, the type of wine, natural or artisanal production methods, storage conditions, and personal taste). For these reasons, no automatic refund or replacement is guaranteed. Each report will be reviewed by our Customer Service team and evaluated on a case-by-case basis, possibly through consultation with the producer or supplier, if deemed necessary.
Under no circumstances will complaints be taken into consideration without the above-mentioned documentation or relating to completely consumed bottles.


11. Errors and limitations of liability

The Product information provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Squisitoo cannot be held responsible, except in cases of willful misconduct or gross negligence.
Squisitoo reserves the right to correct errors, inaccuracies, or omissions, even after an order has been submitted, or to modify or update information at any time without prior notice, without prejudice to the Customer's rights under these General Conditions and the Consumer Code.
Except in the case of fraud or gross negligence, the Customer is excluded from any right to compensation for damages or the recognition of an indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the failure to accept or fulfill, even partially, an order.
Squisitoo promotes responsible consumption of alcohol and excludes any liability, except in cases of willful misconduct or gross negligence, for purchases made by anyone under the age of 18. By purchasing any alcoholic product, you declare that you are of legal age, as per Article 7 of Legislative Decree 158/2012. Squisitoo assumes no liability for purchases made by anyone under the age of 18 who has declared themselves to be of a different age.

12. Complaints

Any complaints must be forwarded to Squisitoo using the specific contact form accessible directly on the Site via the " Contacts " link in the footer, or by calling the toll-free number +393515959859 , active from Monday to Friday, from 8:00-12:30/14:00-17:30 excluding holidays, or by registered mail with return receipt and/or certified email to the following address:
